These Terms of Use ("Terms") are a binding agreement between you and Aifinity Solutions ("Aifinity Solutions", "we", "us") governing your use of the Famloop mobile app and related services (together, "Famloop" or the "Service"). They also serve as the End User License Agreement for the app.
By creating an account, or by using Famloop, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle your information and forms part of these Terms.
You must be at least 18 years old and able to enter into a binding contract to create a Famloop account and agree to these Terms.
A child aged 13 to 17 may use Famloop only as a member of a Loop set up by their parent or legal guardian, who must agree to these Terms on the child's behalf, consent to the collection of that child's location, and supervise their use. The parent or guardian remains responsible for the child's use of the Service and for compliance with these Terms.
Famloop is not intended for children under 13, and accounts may not be created for them. See section 10 of our Privacy Policy.
Famloop is not an emergency service and is not a substitute for one.
Famloop does not contact the police, ambulance, fire service, or any emergency responder or monitoring centre on your behalf. The SOS feature alerts the members of your Loop and nobody else. In an emergency, call your local emergency number.
Famloop is a convenience and awareness tool. Location information is provided on a best-effort basis and may be delayed, inaccurate, incomplete or entirely unavailable for reasons including but not limited to: a dead or low battery; location permission being denied, downgraded to approximate, or revoked; the device being switched off, offline, or without mobile or GPS signal; airplane mode; operating system battery-optimisation, background-restriction or power-saving behaviour; indoor, underground or dense-urban environments; deliberate use of the pause-sharing switch; and interruptions in third-party map, network or cloud services.
Where Famloop cannot determine a member's current position, it is designed to say so rather than show an old position as though it were current. Do not rely on Famloop in any situation where a delay or failure could result in injury, loss or harm. You are responsible for your own decisions and for the safety of those in your care.
Famloop also does not provide medical, legal or security advice, and does not monitor your Loop on your behalf.
Famloop is consent-based by design. Every person whose location appears in a Loop must install the app on their own device, join the Loop themselves, and grant location permission themselves. Famloop cannot locate a phone by its number, and provides no way to track anyone covertly. Every member of a Loop can see the full membership of that Loop, so everyone knows who can see them, and any member can pause sharing or leave at any time.
Using Famloop to monitor any person without their knowledge and consent is strictly prohibited — including by installing the app on a device belonging to another adult, or by pressuring or deceiving someone into joining a Loop. Doing so may violate stalking, harassment, wiretapping, and privacy laws, and may be a criminal offence.
You represent and warrant that you have obtained the informed consent of every person you add to a Loop, and — for a member aged 13 to 17 — that you are their parent or legal guardian, or have that person's consent. You are solely responsible for the lawfulness of your use of the Service, including under the laws of your own jurisdiction.
We may suspend or terminate any account we reasonably believe is being used to monitor a person without their consent.
You must provide accurate information when creating an account and keep it current. You are responsible for keeping your sign-in credentials and any app-lock PIN confidential, and for all activity under your account. Tell us promptly at info@aifinitysolutions.com if you believe your account has been compromised.
One account is for one person. Do not share an account, and do not create an account for someone else except as permitted in section 1.
A "Loop" is a group of members who share location with each other. Loops are joined by invite code. Invite codes expire and can be revoked; do not post them publicly.
Loop administrators can invite and remove members, manage the Loop's saved places and alert rules, and delete the Loop. Removing a member removes their membership and their location history in that Loop. Deleting a Loop deletes its messages, places, timers and safety events for everyone in it, and cannot be undone.
The number of Loops, members, saved places and timers available to you, and the length of location history retained, depend on your plan — see section 7.

We may remove content, or suspend or terminate accounts, that we reasonably believe violate these Terms. We are not obliged to monitor content, but we may review it where necessary to enforce these Terms, respond to a report, or comply with law.
Famloop offers a Free plan and a paid Premium Family subscription. Premium Family raises the limits on Loops, members, saved places and timers, extends location history retention, and unlocks additional alerting features. Current prices, periods and any introductory or trial offer are shown in the app before you purchase, are set by your app store and vary by region.
One subscription covers the whole Loop. When any member subscribes, the Loop is covered for as long as that subscription remains active.
These Terms are between you and Aifinity Solutions only, not with Apple Inc. or Google LLC. The app stores are not responsible for Famloop or its content.
For the iOS app: your licence is limited to using Famloop on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. Apple has no obligation to provide maintenance or support for Famloop. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory non-compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government restricted-party list.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Famloop on devices you own or control, for your own non-commercial use. This licence ends when these Terms end.
Famloop, its software, design, content and trademarks are owned by Aifinity Solutions and its licensors and are protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you.
If you send us feedback or suggestions, you grant us an unrestricted, royalty-free right to use them without obligation to you.
You retain ownership of the content you submit — your messages, profile photo, place names and similar. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and transmit that content solely to operate and provide the Service to you and your Loop.
You are responsible for your content and represent that you have the rights to submit it and that it does not violate these Terms or any law.
Famloop relies on third-party services, including Google Firebase, Google Maps Platform, RevenueCat and the app stores. Their availability, accuracy and performance are outside our control, and your use of mapping and place information is also subject to Google's applicable terms. We are not responsible for third-party services or for any loss arising from their failure or inaccuracy.
You may stop using Famloop at any time and delete your account from Settings → Delete account. Deleting your account is permanent and is described in our Privacy Policy. It does not automatically cancel a subscription — cancel that in your app store.
We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to by law, or if we discontinue the Service. We may discontinue Famloop or any feature at any time; where practical we will give reasonable advance notice in the app so you can export your data.
Sections 9, 10, and 13 to 16 survive termination.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMLOOP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT ANY LOCATION, ALERT, NOTIFICATION, ARRIVAL ESTIMATE OR OTHER INFORMATION IT PROVIDES WILL BE ACCURATE, COMPLETE, CURRENT OR DELIVERED. SEE SECTION 2.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you, and nothing in these Terms limits any non-waivable statutory right you have as a consumer.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIFINITY SOLUTIONS AND ITS OFFICERS, EMPLOYEES, AGENTS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY, PROPERTY DAMAGE OR OTHER LOSS ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING ANY INACCURATE, DELAYED, UNDELIVERED OR MISSING LOCATION INFORMATION OR ALERT — WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
These limitations do not apply to liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
You agree to indemnify and hold harmless Aifinity Solutions and its officers, employees and agents from any claim, liability, damage, loss or expense (including reasonable legal fees) arising out of your use of the Service, your content, your breach of these Terms, or your violation of any law or of any third party's rights — including any claim that you monitored a person without their consent.
These Terms are governed by the laws of the State of [STATE], United States, and the federal laws of the United States, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and Aifinity Solutions agree to the exclusive jurisdiction of the state and federal courts located in [COUNTY, STATE], United States, for any dispute arising out of or relating to these Terms or the Service, and each party waives any objection to venue there.
Before filing a claim, you agree to try to resolve the dispute informally by contacting info@aifinitysolutions.com; we will try to do the same. If it is not resolved within 60 days, either party may pursue the claim.
If you are a consumer resident in the European Economic Area, the United Kingdom or another jurisdiction whose law entitles you to the protection of your local mandatory consumer rules and courts, nothing in this section deprives you of that protection.
We may update these Terms as the Service changes. The "Last updated" date above reflects the current version. For material changes we will give notice in the app before they take effect. Continuing to use Famloop after a change takes effect means you accept the updated Terms; if you do not accept them, stop using the Service and delete your account.

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
